Key Features of the 400 Visa

Duration

  • The 400 visa allows applicants to stay in Australia for up to 3 months. In some cases, a stay of up to 6 months may be granted, but only in exceptional circumstances

Specialised Work

  • The work must be highly specialised and non-ongoing, meaning that it is not expected to form part of Australia’s regular labour market.

Multiple Entry

  • Applicants can apply for a visa that allows multiple entries into Australia during their stay, depending on the requirements of the project. Grant of multiple entry is at discretion of Department of Home Affairs

Eligibility Requirements

To apply for a Subclass 400 visa, applicants must meet several key eligibility criteria:

    Genuine Temporary Stay:

    The visa is intended for short-term work only, and applicants must demonstrate that their stay is temporary and will not extend beyond the visa’s grant period.

    Highly Specialised Skills:

    Applicants must possess skills or knowledge that are highly specialised and cannot be found within the local Australian workforce. This could include technical, professional, or specialised work on specific projects or for unique roles.

    Non-Ongoing Work:

    The work must be non-ongoing, meaning it is project-based, and the position will not be available as a permanent role in the Australian labour market.

    Location at time of application:

    You must be outside Australia at time of application and decision.

Designated Regional Areas

Regional Australia includes areas outside of Sydney, Melbourne, and Brisbane. These areas are classified into two categories:

Cities and Major Regional Centres (e.g., Perth, Adelaide, Gold Coast).
Regional Centres and Other Regional Areas (e.g., towns and rural areas outside the major cities).

Labour Market Testing (LMT) for the 494 Visa

Before nominating a foreign worker, businesses are generally required to demonstrate that they have advertised the position locally and made genuine efforts to recruit Australian workers. Exceptions to this requirement may apply in certain circumstances, such as international trade agreements.
